Compliance Management – Die Umsetzung der Whistleblower Richtlinie (openHPI)

Seit 2019 gilt eine EU-Richtlinie, die bis Ende des Jahres auch von deutschen Unternehmen und Organisationen umgesetzt werden muss, wollen sie nicht empfindliche Strafen riskieren: Die Whistleblower Richtlinie. Danach müssen Mitarbeiter die Möglichkeit haben, Verstöße und Missstände in ihrer Organisation zu melden ohne selbst dadurch Schaden zu nehmen, z.B. durch Mobbing oder Jobverlust. In diesem Kurs werden wir beleuchten, wie dies in der Praxis aussehen kann.

Whistleblower wie Edward Snowden oder Frances Haugen haben für großes Aufsehen weltweit gesorgt. Mit ihrem „Verrat“ haben sie ganze Regierungen und große Konzerne ins Wanken gebracht.
Seit 2019 gilt eine EU-Richtlinie, die der deutsche Gesetzgeber längst in nationales Recht hätte umsetzen müssen. Bis Ende des Jahres 2022 soll die Umsetzung nun durch ein sogenanntes „Hinweisgeberschutzgesetz“ erfolgen.
Spätestens mit Ablauf der dort vorgesehenen Fristen müssen auch deutsche Unternehmen mit mehr als 50 Mitarbeitern die Vorgaben beachten, wollen sie nicht empfindliche Strafen riskieren. Mitarbeiter müssen also z.B. die Möglichkeit haben, Verstöße und Missstände in ihrer Organisation zu melden, ohne selbst Nachteile bis hin zur Kündigung fürchten zu müssen.
In diesem Kurs werden wir beleuchten, wie dies in der Praxis aussehen kann. Welche Stellen muss ein Unternehmen neu einrichten, um derartige Hinweise entgegenzunehmen? Welche Meldungen fallen überhaupt unter die neuen Vorgaben? Wie schützen wir die Identität des Hinweisgebers?
Zuerst einmal bedeutet diese Richtlinie zusätzliche Arbeit und Kosten für die Unternehmen. Doch was ist der Mehrwert, von dem die Unternehmen langfristig profitieren?
